1. About These Terms

These Terms of Use ("Terms") govern your use of the Resilyo mobile application ("the App"), published by FORETALE STUDIO (FTS), a simplified joint-stock company (SASU) registered in Lyon, France (SIREN 938 483 914) ("the Publisher", "we", "us").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

2. Description of the Service

Resilyo is a mobile application designed to help households prepare calmly and progressively for everyday disruptions (power outages, water cuts, supply shortages). The App is free to download on app stores (Google Play Store, Apple App Store). A single, optional in-app purchase, "Resilyo Complete", permanently unlocks all features. There is no subscription. The App provides:

  • Home stock tracker — An inventory tool for tracking household emergency supplies.
  • Emergency bag checklist — A portable emergency bag organizer.
  • Educational guides — Informational modules on household resilience.
  • Maintenance calendar — Reminders for supply rotation and expiry tracking.

The App is designed to work without the internet. Every feature — inventory, emergency bags, guides, reminders — stays fully available during a power cut, a network outage, or any other loss of connectivity: that is precisely the situation the App is built for. Your content is stored on your device.

The App also keeps its use of the network to a strict minimum. The exchanges that do exist are optional or started by you, and none of them identifies you personally:

  • Update check — the App reads a public version file hosted by the Publisher to tell you when a newer version is available (it may also announce a current promotion). It sends nothing about you and can be switched off in Settings.
  • In-app purchase and restore — handled entirely by the App Store or Google Play (see the In-app purchase section).
  • Review prompt — the standard store review prompt, which transmits no App data.
  • Bug report — opens a pre-filled email that you send yourself, from your own mailbox.

In-app purchase "Resilyo Complete"

The free version of the App provides a core set of features usable without time limit. The one-time "Resilyo Complete" in-app purchase is a non-consumable product: it permanently unlocks all features, with no subscription and no recurring fees.

The exact price, in your currency, is displayed by the App Store or Google Play before any purchase confirmation. Payment is processed exclusively by Apple or Google and tied to your app-store account; the publisher collects no payment data.

A promotional price may be offered from time to time, and the App may indicate that a promotion is running. The price shown by the App Store or Google Play at the moment of purchase always prevails.

The purchase can be restored free of charge at any time on any device signed in to the same store account ("Restore my purchase" feature), including after a reinstall or a device change. Refund requests are governed by Apple's and Google's policies and must be addressed to them directly.

3. Nature of Recommendations

3.1 Indicative Information Only

All quantities, item lists, and recommendations provided by the App are strictly indicative. They are an original compilation by the Publisher, developed through cross-referencing multiple publicly available official sources, including:

  • OFAE (Swiss Federal Office for Civil Protection)
  • BBK (German Federal Office of Civil Protection and Disaster Assistance)
  • info.gouv.fr (French Government)
  • Canadian Government (getprepared.gc.ca)

Quantities and item selections have been adapted, recalculated, and supplemented by the Publisher; they do not reproduce any source content as-is.

These recommendations are not validated by any health authority and do not constitute medical, dietary, nutritional, or professional advice of any kind.

3.2 No Medical Advice

The App does not provide medical advice. Item lists that include health-related supplies (e.g., first aid items, common medications) are provided as checklists only, without dosage, posology, or treatment recommendations. You must consult a qualified healthcare professional for any medical decision.

3.3 No Guarantee of Completeness

The App does not guarantee that its recommendations are complete, sufficient, or appropriate for your specific situation. Individual needs vary significantly based on health conditions, allergies, dietary requirements, family composition, geographic location, climate, and other factors.

4. User Responsibilities

4.1 Adaptation to Personal Needs

You are solely responsible for adapting the App's recommendations to your personal and household situation, including but not limited to:

  • Allergies, food intolerances, and dietary restrictions
  • Medical conditions and ongoing treatments
  • Specific nutritional needs (infants, elderly, pregnant persons)
  • Local regulations and conditions

4.2 Custom Content

Any items, quantities, or data you add to the App are entered at your own discretion and responsibility. The Publisher has no visibility into, control over, or responsibility for user-entered content.

4.3 Lawful Use

You agree to use the App only for lawful purposes consistent with its intended use as a household preparedness tool.

5. Intellectual Property

5.1 App Content

The App, its design, code, illustrations, educational content, and user interface are the intellectual property of the Publisher, protected by applicable copyright laws and international treaties.

5.2 Official Sources

Factual data from official government sources is used for informational purposes. See the Legal Notice for full source attribution:

  • French Government Information Service — info.gouv.fr (France), under Etalab Open Licence 2.0
  • Federal Office for Civil Protection (BABS/OFAE, Switzerland)
  • Federal Office of Civil Protection and Disaster Assistance (BBK, Germany)

The App is not affiliated with, endorsed by, or approved by any government agency.

5.3 Your Content

Data you enter into the App (inventory, household composition, preferences) remains your property and is stored exclusively on your device.

6. Limitation of Liability

6.1 "As Is" Provision

The App is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or completeness.

6.2 Exclusion of Liability

To the maximum extent permitted by applicable law, the Publisher shall not be liable for:

  • The adequacy or inadequacy of recommendations to your specific needs
  • Consequences arising from misinterpretation of information provided
  • Insufficiency of preparation in the event of an actual emergency
  • Loss of data stored on your device
  • Any indirect, incidental, special, or consequential damages

6.3 Consumer Protection Notice

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable consumer protection law, including but not limited to the French Consumer Code (Code de la consommation) and EU consumer protection regulations. Clauses that would be deemed unfair under Article L.212-1 of the French Consumer Code are severable and shall not affect the validity of the remaining Terms.

7. Privacy and Data

Your privacy is fundamental to the App's design. Please refer to our separate Privacy Policy for full details. In summary:

  • All data is stored locally on your device
  • Your content is never collected by, transmitted to, or accessible to the Publisher
  • No user accounts, no cloud synchronisation, no analytics, no tracking

8. Future Updates and Changes

8.1 Changes to the App

The Publisher reserves the right to modify, update, or discontinue the App or any of its features at any time. Future versions may introduce optional online features (such as cloud backup, synchronization, or community features). Any such features will:

  • Be clearly communicated to you before activation
  • Require your explicit consent before any data transmission
  • Be governed by updated Terms and Privacy Policy, which you will be asked to accept

8.2 Changes to These Terms

We may update these Terms from time to time. When we do:

  • The updated Terms will be made available within the App
  • You will be prompted to review and accept the new Terms
  • The version number and effective date will be updated
  • Your continued use after acceptance constitutes agreement to the updated Terms

If you do not agree to updated Terms, you may stop using the App. Data already stored on your device remains yours regardless.

9. Termination

You may stop using the App at any time by uninstalling it. Upon uninstallation, all locally stored data is deleted according to your device's operating system behavior.

The Publisher may discontinue the App at any time. This will not affect data already stored on your device.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of France. Any dispute arising from or in connection with these Terms shall be submitted to the competent courts of France.

For users outside France, mandatory local consumer protection laws may apply in addition to these Terms. Nothing in these Terms limits your rights under such mandatory provisions.

11. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
