2. The Application

Osir is a mobile application for Android and iOS, and a web version, published by FORETALE STUDIO. Application identifier: com.foretalestudio.osir.

It is distributed through:

• Google Play — Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States;
• Apple App Store — Apple Inc., One Apple Park Way, Cupertino, CA 95014, United States.

The stores host the application binaries for distribution only.

3. Hosting

The Publisher operates an online service ("the portal"), reached at portal.foretalestudio.com, which holds the users' accounts and, where applicable, their purchase records; it holds no health data in this version, as the synchronisation of such data is not offered. The portal and the Publisher's website foretalestudio.com, which publishes this notice and the other legal documents, are hosted by:

The servers are located in the European Union. The personal data held on the portal are described in the Privacy Policy.

4. Intellectual Property

The Osir application — its name, its mark, its source code, its design, its illustrations, its lessons, its programme packs, its food and product databases and their arrangement, its texts and its interface — is the property of FORETALE STUDIO or of its licensors, and is protected by the French Intellectual Property Code, the Berne Convention and Directive (EU) 2019/790.

Any reproduction, representation, adaptation, distribution or extraction, in whole or in part, without the prior written consent of the Publisher is prohibited, except for the private use permitted by law.

Osir and the djed mark are distinctive signs of FORETALE STUDIO. Third-party brands and product names cited in the application are cited for identification only, without any affiliation, sponsorship or endorsement, and remain the property of their respective owners. A rights holder who wishes a name removed may write to contact-us@foretalestudio.com.

5. Data Sources

Nutritional data may come from Open Food Facts (Open Database License, ODbL) and from the Ciqual table of ANSES (Etalab Open Licence 2.0). Product photographs from Open Food Facts are used under the CC BY-SA licence with attribution to their contributors. Label values entered by the user or read by the camera are the user's own. The open-source software components are listed in the application under Settings → Legal → Licences.

6. Nature of the Content

Osir is an informational companion, not a medical device within the meaning of Regulation (EU) 2017/745. It makes no diagnosis, gives no medical, dietary or nutritional advice, and makes no therapeutic, curative or preventive claim (Regulation (EC) No 1924/2006). Nutritional values displayed do not constitute official labelling within the meaning of Regulation (EU) No 1169/2011. The programmes are original compilations by the Publisher; the application is not affiliated with, endorsed by or approved by any weight-loss centre, clinic, health authority, method or branded programme. Users must consult a health professional before starting any eating programme. See the Terms of Use.

7. Liability

The Publisher provides the app with care and diligence and endeavours to keep it accurate and up to date. The app is an information and planning tool: its content is neither medical advice, nor a diagnosis, nor follow-up. What the Publisher undertakes to do, what it does not undertake, what the user answers for and what the Publisher answers for are set out in §9 of the Terms of Use. The Publisher's liability toward a consumer is neither limited nor excluded there: the Terms contain no cap, no exclusion list and no indemnity clause against a consumer, and liability for death or personal injury, for gross negligence or wilful misconduct, under the legal guarantee of conformity for digital content and services and under liability for defective products (Directive (EU) 2024/2853, which applies to software) is unrestricted.

8. Consumer Mediation

In accordance with Articles L.611-1 and following of the French Consumer Code, a consumer may, after having written to the Publisher without obtaining a satisfactory answer within one month, refer the dispute free of charge to a consumer mediator.

The Publisher has not yet designated a consumer mediator; one will be designated no later than before the first paid offer, and the details will then be published here. In the meantime, any complaint may be sent to contact-us@foretalestudio.com.

9. Personal Data

10. Applicable Law

This notice is governed by French law. Any dispute falls under the jurisdiction of the competent French courts, subject to the mandatory consumer-protection provisions of the user's country of residence.
